Land & Property

Title verification, Record of Rights and mutation, partition, and property disputes before civil courts and revenue authorities.

Land in Odisha is recorded in two parallel systems: the registered deeds that transfer ownership, and the revenue records, chiefly the Record of Rights, that show who holds each plot. Many disputes begin where the two do not match. Work in this area starts with reading both sets of records in full.

What this area covers

Title verification

Reading the chain of title deeds together with the current and earlier settlement Records of Rights, the encumbrance certificate from the Sub-Registrar's office and the land's recorded classification (kisam), to see whether a seller can pass clear title and what risks remain. This is often done before a purchase, a loan against property or a family settlement.

Record of Rights and mutation

Applications and objections in mutation and record-correction cases before the Tahasildar, and appeals and revisions before the higher revenue authorities. A mutation entry updates the revenue record; it does not by itself decide ownership, so the deed or the basis of succession needs to be in order as well.

Partition

Dividing jointly held or inherited property, either by agreement in a family settlement or partition deed, or through a partition suit in the civil court where the sharers cannot agree.

Property disputes

Suits for declaration of title, recovery of possession and injunction, and disputes over boundaries, encroachment and access, before the civil courts, together with related proceedings before revenue authorities.
