The short answer
Sale and gift deeds of immovable property in Odisha are registered at the District Sub-Registrar or Sub-Registrar office for the area, using the IGR Odisha system. You check the benchmark value, pay stamp duty (the IGR fee table shows 5% for a sale or gift of immovable property, and IGR Odisha states 4% for a purchase by a woman through a sale deed) and a registration fee of 2%, book an online slot, and present the deed with both parties and witnesses for biometric capture.
Why registration matters
Under the Transfer of Property Act, 1882, a sale of immovable property worth one hundred rupees or more, and any gift of immovable property, can be made only by a registered instrument. An unregistered "sale agreement", a notarised deed or a power of attorney does not transfer ownership. A gift also has to be accepted by the person receiving it during the giver's lifetime. Registration is followed by mutation in the Record of Rights; see mutation in Odisha.
Before drafting: check the land
- Current Record of Rights on Bhulekh: the seller or donor should be the recorded holder, or their title should be traceable (see reading an RoR).
- An encumbrance certificate for the plot (see encumbrance certificate in Odisha).
- The kisam, and whether conversion is needed for the intended use (see land conversion).
- All co-sharers joining if the khata is joint, and any restriction on transfer (for example, Scheduled Tribe land or government-settled land with conditions).
The full list is in the land-buying checklist.
Step by step
- Find the benchmark value. Look up the market value fixed for the village, kisam and plot on the IGR Odisha portal or at the registration office. Stamp duty is charged on the higher of the stated price and this value.
- Draft the deed. The parties, a licensed deed writer or an advocate can draft it; IGR Odisha and the Revenue Department publish model deeds. The schedule should match the Record of Rights exactly: district, tahasil, mouza, khata, plot numbers, kisam, area and boundaries.
- Pay stamp duty. By e-stamp, electronic franking or impressed stamp paper from licensed vendors or treasuries.
- Book a slot. IGR Odisha's slot booking FAQ states that registration is not permitted without an online slot ticket, booked on the IGR portal with Aadhaar or PAN and an OTP, for a fixed fee of Rs 300, with no cancellation or refund. Slots can also be booked on the state's e-registration mobile app launched in June 2025.
- Present the deed. At the Sub-Registrar's office, with a true copy. The office checks it, generates a document ID and enters the details.
- Pay the registration fee. At the office or through the Odisha treasury portal.
- Biometrics and admission. Photographs, thumb impressions and signatures of the executant, the claimant and the identifying witnesses are captured, and the executant admits execution before the Registering Officer.
- Registration and return. The Registering Officer registers the document, the endorsements and certificate are printed on the original, and it is scanned and returned. Where required, the registration office sends intimation to the Tahasil for mutation.
Stamp duty and registration fee
As shown on IGR Odisha's fee pages at the time of writing:
| Document | Stamp duty | Registration fee |
|---|---|---|
| Sale of immovable property | 5% of the higher of consideration and market value | 2% |
| Sale of immovable property to a woman | 4% (as stated by IGR Odisha) | 2% |
| Gift of immovable property | 5% | 2% |
| Settlement | 2% | 2% |
| Partition | 2% | 2% |
The fee table does not show a separate reduced rate for gifts to family members. Some secondary sources say the women's concession extends to gifts in favour of women; ask the Sub-Registrar or use the IGR calculator for your exact document before buying stamps. For apartments, the Indian Stamp (Odisha Amendment) Act, 2026 replaced the old 3%/4%/5% slabs with a uniform 5% duty on transfer of apartment units.
Papers to take to the office
- The original deed on stamp paper (or with e-stamp certificate) and one true copy.
- The slot booking ticket.
- Identity proof of the executant, claimant and two identifying witnesses, and PAN or the prescribed declaration where the value requires it.
- Copy of the current Record of Rights and recent rent receipt.
- Photographs as asked, and the power of attorney if someone signs for a party (it must itself be valid and, for sale, properly stamped).
- Any permission needed for the transfer, for example court permission to sell a minor's share.
Timing points
- A document must generally be presented for registration within four months of execution under the Registration Act, 1908.
- A registered document operates from the date of execution, not from the date of registration.
- Certified copies of registered documents can be applied for from the registration office or online.
Gift deeds: points families miss
- The donor must own the property and have the capacity to give it; a co-sharer can gift only their share.
- Acceptance by the donee should be recorded in the deed, and the donee usually signs it.
- A gift once complete cannot generally be revoked, except as the Transfer of Property Act allows (for example, on a condition agreed in the deed). For senior citizens, the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 allows a transfer made on condition of care to be declared void if that condition is not kept.
- Within a family, a will or a registered partition may suit the purpose better; compare with partition of family land.
When a registered gift can be cancelled, and the time limit for a suit, are explained in cancelling a gift deed in Odisha. Buying and checking stamp paper is covered in e-stamp paper in Odisha.
After registration
- Collect the registered original and keep it safely.
- Follow the mutation at the Tahasil and check the updated RoR on Bhulekh.
- Pay land revenue in the new name.
