The short answer

A succession certificate is a civil court's authorisation to collect a deceased person's debts and securities, such as bank deposits and shares. It is applied for by petition under Section 372 of the Indian Succession Act, 1925 to the District Judge where the deceased ordinarily lived. It does not cover land, and for smaller bank deposits banks now often settle claims without one.

What a succession certificate is for

A succession certificate is granted by a civil court under Part X of the Indian Succession Act, 1925 (Sections 370 to 390). It authorises the person named in it to collect debts and securities owed to someone who has died, such as bank deposits, shares, debentures, government securities, and money due under policies or from employers, and to give a valid discharge to whoever pays. The person or institution that pays the certificate holder in good faith is protected (Section 381).

It does not decide who owns the money in the end, and it does not deal with land or houses. Ownership of all the property still goes by the applicable succession law, or by a will; see how family property is divided without a will.

In Odisha, the district administration describes the legal heir certificate as issued by the Tahasildar or Additional Tahasildar, Sub-Collector or Collector, on an application in the prescribed form at the native Tahasil with the death certificate, an affidavit and supporting papers, and an appeal within three months to the next higher revenue officer. Check the current procedure with the Tahasil.

Where the deceased left a will, the executor or beneficiary generally needs probate or letters of administration with the will annexed rather than a succession certificate; see wills and probate in Odisha.

Do you actually need one?

Often not, for modest amounts.

  • Bank accounts with a nominee or a survivor clause: the bank pays the nominee or survivor on proof of death and identity. Under the Reserve Bank of India's 2025 directions on deceased customers' claims, banks should not insist on a succession certificate in such cases unless a court order restrains payment.
  • Bank accounts with no nominee: the same RBI directions require banks to follow a simplified procedure, without a succession certificate, up to ₹15 lakh for commercial banks and ₹5 lakh for co-operative banks, on a claim form, death certificate, indemnity bond and a no-objection from the other heirs. Above that, the bank may ask for a succession certificate or similar document. Banks are to settle deposit claims within 15 days of receiving complete documents. These directions were to be implemented by 31 March 2026; ask the bank for its current threshold.
  • Shares and securities: companies and depositories have their own transmission procedures and limits. For larger holdings, or where there is no nominee, a succession certificate or probate is commonly asked for.

Remember that a nominee usually receives the money for the legal heirs, not as owner. In Shakti Yezdani v. Jayanand Jayant Salgaonkar (2023), the Supreme Court held this applies to shares as well.

Which court in Odisha

The petition is filed before the District Judge within whose jurisdiction the deceased ordinarily resided at the time of death, or, if there was no fixed place of residence, where any part of the property is found (Section 371). In practice the matter may be assigned to another civil court in the judgeship. Court locations are listed under courts.

What the petition must contain

Section 372 requires the petition to be signed and verified and to state:

  • the time of the deceased's death;
  • the deceased's ordinary residence at that time, and where property is situated if outside the jurisdiction;
  • the family or other near relatives of the deceased and their addresses;
  • the right in which the petitioner claims;
  • the absence of any impediment to the grant; and
  • the debts and securities for which the certificate is sought.

Documents usually attached

  • Death certificate
  • Proof of the relationship of each heir, and a family tree (a legal heir certificate is often used)
  • Statements, passbooks, folios or certificates showing each debt or security
  • Identity and address proof of the petitioner
  • No-objection affidavits from other heirs, where they consent

Court fee

A court fee calculated on the value of the debts and securities is payable before the certificate is issued. The applicable rate in Odisha depends on the court-fees law in force in the State; check the current figure with the court before filing.

How the case moves

  1. Filing of the petition with documents.
  2. Notice is served on the heirs named, and a general notice is published, for example in a newspaper and on the court notice board, inviting objections (Section 373).
  3. Hearing. If there is no objection, the court decides on the papers and the petitioner's evidence. If there is a contest, the court decides summarily who appears to have the stronger right to it; the full question of title is left to a regular suit.
  4. Security. The court may require the petitioner to give a bond, with or without surety, to answer for amounts received (Section 375).
  5. Grant. The certificate specifies the debts and securities it covers and is issued once the court fee is paid. A certificate can later be extended to other debts (Section 376).

An uncontested petition typically takes some months, depending on the court's workload and the time needed for publication. A certificate can be revoked if it was obtained by fraud or concealment (Section 383). An appeal against an order granting, refusing or revoking a certificate lies to the High Court (Section 384).

Practical points

  • List every account and holding in one petition, so that a second application is not needed.
  • All heirs should be named, including married daughters. Leaving out an heir is a ground for revocation.
  • For land and buildings, the heirs apply for mutation at the Tahasil instead.

Frequently asked questions

What is the difference between a succession certificate and a legal heir certificate?

A succession certificate is issued by a civil court under the Indian Succession Act and authorises collection of debts and securities. A legal heir certificate is issued in Odisha by revenue officers such as the Tahasildar and identifies the heirs, mainly for pensions and government dues.

Is a succession certificate needed for a bank account with a nominee?

Generally no. The bank pays the nominee on proof of death and identity, unless a court order restrains payment. The nominee, however, usually holds the money for the legal heirs.

Can a succession certificate be used to transfer land?

No. It covers only debts and securities. For land and buildings, the heirs apply for mutation at the Tahasil, and any dispute over ownership goes to the civil court.

Which court issues a succession certificate in Odisha?

The District Judge within whose jurisdiction the deceased ordinarily resided at death, or where the property is found if there was no fixed residence, under Section 371 of the Indian Succession Act.

How long does it take to get a succession certificate?

An uncontested petition usually takes some months, because notice must be served on the heirs and published before the hearing. A contested petition takes longer.

Do I need a succession certificate if there is a will?

Usually not. Where there is a will, probate or letters of administration with the will annexed is the appropriate route.
