The short answer

If your insurance claim is rejected in Odisha, first complain in writing to the insurer's grievance officer, then escalate on IRDAI's Bima Bharosa portal (155255). If the insurer rejects the complaint or does not reply within a month, you can approach the Insurance Ombudsman, Bhubaneswar within one year, free of cost, for claims up to ₹50 lakh. A consumer commission complaint within two years is the other main route.

When an insurance claim is rejected in Odisha, whether under a health, vehicle or life policy, you do not have to start with a court case. There is a fixed ladder of remedies: a written complaint to the insurer, the IRDAI's Bima Bharosa system, the Insurance Ombudsman at Bhubaneswar, and the consumer commission or civil court. Each step costs little or nothing, and the papers you build at the first step decide how strong the later ones are.

Insurance claim rejected in Odisha: read the rejection letter first

An insurer that refuses a claim, fully or partly, should give its reasons in writing (a repudiation letter). Read it against the policy wording, not the brochure. Common reasons are:

  • Non-disclosure of an earlier illness or a material fact in the proposal form;
  • a waiting period or exclusion clause (for example, a pre-existing disease still within its waiting period);
  • late intimation of the claim, or missing documents;
  • for vehicles, an invalid driving licence, use outside the permitted purpose, or a dispute over the surveyor's assessment;
  • a lapsed policy because a premium was not paid in time.

Ask the insurer in writing for every document it relied on, such as the investigator's or surveyor's report, so that you can answer it point by point.

Rules that often help the policyholder

  • Life insurance, three-year rule. Under Section 45 of the Insurance Act, 1938, a life policy cannot be called in question on any ground, including misstatement or fraud, after three years from the date of the policy or its revival. Within the three years, the insurer must still prove that a misstatement was material or fraudulent.
  • Health insurance moratorium. Under IRDAI's 2024 health insurance framework, once a policy has run continuously for 60 months, a claim cannot be contested on the ground of non-disclosure or misrepresentation, except for established fraud. The waiting period for pre-existing diseases can be no longer than 36 months.
  • Cashless timelines. IRDAI's May 2024 master circular requires insurers to decide a cashless request within one hour and to give final discharge authorisation within three hours of the hospital's request. If cashless is refused, you can still pay the hospital and file a reimbursement claim.
  • Vehicle theft. The Supreme Court has held that if the FIR was lodged promptly, a theft claim should not be rejected only because the insurer was told late (Gurshinder Singh v. Shriram General Insurance, 2020).

Step 1: complain in writing to the insurer

Write to the insurer's Grievance Redressal Officer (the email ID is on the policy and the insurer's website). Quote the policy and claim numbers, explain why the rejection is wrong, and attach the documents. Keep the complaint reference number. IRDAI expects insurers to acknowledge a complaint at once and resolve it within 14 days. Many insurers also have a review or internal ombudsman level; use it, but keep track of the time limits for the next steps.

Step 2: escalate through Bima Bharosa (IRDAI)

If the insurer does not reply or you are not satisfied, register the complaint with IRDAI:

  • online on the Bima Bharosa portal, where you can track it;
  • by email to complaints@irdai.gov.in; or
  • by the toll-free numbers 155255 or 1800 4254 732.

IRDAI takes the complaint up with the insurer; it does not decide the claim like a court. Only the insured or the claimant can file it, not an agent or advocate on their behalf.

Step 3: Insurance Ombudsman, Bhubaneswar

The Ombudsman under the Insurance Ombudsman Rules, 2017 is the main free forum for individual policyholders. The office for the whole of Odisha is:

Office of the Insurance Ombudsman, 62, Forest Park, Bhubaneswar 751009. Phone 0674-2596461 / 2596455; email oio.bhubaneswar@cioins.co.in. The office details are listed by the Council for Insurance Ombudsmen, where a complaint can also be filed online. Confirm the current address there before posting anything.

ConditionWhat it means
Insurer approached firstThe insurer rejected your written complaint, did not reply within one month, or replied in a way you do not accept.
Time limitWithin one year of the insurer's reply, or of the end of that one month. Delay can be condoned for reasons.
ValueCompensation sought up to ₹50 lakh, including expenses.
No parallel caseThe same dispute must not be pending before, or decided by, a court, consumer commission or arbitrator.
FeeNone. You can appear yourself; hearings can be held by video.

The Ombudsman can deal with full or partial rejection of claims, delay in settlement and disputes about premium or policy terms, against insurers, agents and brokers. It may first try mediation; if you accept a recommendation in writing as full and final, the insurer must comply within 15 days. Otherwise it passes a reasoned award, normally within three months of receiving all your documents. The award binds the insurer, which must comply within 30 days, but it does not bind you: if you are not satisfied you can still use other remedies.

Step 4: consumer commission or civil court

A wrongful rejection is a deficiency in service under the Consumer Protection Act, 2019. You can file a complaint before the District Consumer Commission where you live, online on e-Jagriti, within two years of the rejection. The commission can award the claim amount, interest, compensation for harassment and costs. Which commission hears it depends on the value of the consideration paid, so check the limits in the consumer complaint guide. Choose one forum: once a consumer case is pending, the Ombudsman will not hear the same dispute.

A civil suit is also possible, and is sometimes needed for complex questions or very large claims. Many general insurance policies contain an arbitration clause for disputes about the amount payable when liability is admitted; read your policy.

Health, vehicle and life claims: points specific to each

  • Health: keep the discharge summary, all bills, investigation reports and prescriptions. If only part of the claim was paid, ask for the deduction sheet explaining each item.
  • Vehicle (own damage): keep the FIR (for theft or a major accident), the surveyor's report, repair estimates and photographs. Claims against the other driver's insurer for injury or death go to the Motor Accident Claims Tribunal instead; see motor accident claims in Odisha.
  • Life: keep the death certificate, medical records and the policy bond. If the insurer alleges non-disclosure, ask which proposal answer it says was false and what evidence it has.

Documents to keep ready

  1. Policy schedule and full policy wording, and proposal form copy.
  2. Claim form, claim intimation proof, and all letters and emails with the insurer.
  3. The repudiation letter and the grievance complaint with its reference number.
  4. Medical, repair or death records, as the case may be.
  5. Proof of premium payment, and a short date-wise note of events.

A formal notice before filing is not required for the Ombudsman but can help before a consumer case; see legal notices in Odisha. If you cannot afford representation, see free legal aid in Odisha. Consumer and insurance disputes are listed under consumer disputes.

Frequently asked questions

Where is the Insurance Ombudsman office in Odisha?

The Insurance Ombudsman for Odisha sits at 62, Forest Park, Bhubaneswar 751009 (phone 0674-2596461, email oio.bhubaneswar@cioins.co.in). Complaints can also be filed online through the Council for Insurance Ombudsmen website. Confirm the current details there before visiting.

What can I do if my health insurance claim is rejected?

Ask for the written reasons and documents relied on, complain to the insurer's grievance officer, escalate on Bima Bharosa, and then approach the Insurance Ombudsman or the District Consumer Commission. If the policy has run continuously for 60 months, non-disclosure cannot be used to contest the claim except for established fraud.

Is there a fee to complain to the Insurance Ombudsman?

No. The Ombudsman charges no fee, and you can present the complaint yourself, including by video hearing.

What is the time limit for an Insurance Ombudsman complaint?

Within one year of the insurer's rejection of your complaint, or of the expiry of one month after you complained if the insurer did not reply. The Ombudsman can condone delay for reasons.

Can a life insurance claim be rejected after three years?

Under Section 45 of the Insurance Act, 1938, a life policy cannot be called in question on any ground, including fraud, after three years from the date of the policy or its revival.

Should I go to the Insurance Ombudsman or the consumer court?

Either can be used, but not both for the same dispute at the same time. The Ombudsman is free, informal and limited to ₹50 lakh, and its award binds only the insurer. A consumer commission can also award compensation and costs, with a two-year limit.
